The party/client purchasing this service or product hereby certifies and accept all the following terms of service:

NOTE: CUSTOMER IS RESPONSIBLE FOR OBTAINING ALL NECESSARY PERMITS.

Please read these Terms carefully. By accessing or using the Loamscape Platform,  You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of the Loamscape Platform is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.

All drivers must adhere to driving safe, no alcohol or drugs in car. All drivers must keep their cars cleaned at all times and all drivers must follow the community guidelines. Any driver who does not adhere to this will be deactivated

In order to use the Services, you must first agree to the Terms. You can accept the Terms by:

  • Clicking to accept or agree to the Terms, where it is made available to you by Loamscape in the user interface for any particular Service; or

  • Actually using the Services. In this case, you understand and agree that Loamscape will treat your use of the Services as acceptance of the Terms from that point onwards.

DEFINITIONS

Customer

"Customer" or "You" or "Your" refers to you, as a customer of the Services. A customer is someone who accesses or uses the Services for the purpose of sharing, displaying, hosting, publishing, transacting, or uploading information or views or pictures and includes other persons jointly participating in using the Services.

Content

"Content" will include (but is not limited to) reviews, images, photos, audio, video, location data, nearby places, and all other forms of information or data. "Your content" or "Customer Content" means content that you upload, share or transmit to, through or in connection with the Services, such as likes, ratings, reviews, images, photos, messages, chat communication, profile information, or any other materials that you publicly display or displayed in your account profile. "Loamscape Content" means content that Loamscape creates and make available in connection with the Services including, but not limited to, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate ratings, reports and other usage-related data in connection with activities associated with your account and all other elements and components of the Services excluding Your Content and Third Party Content. "Third Party Content" means content that comes from parties other than Loamscape or its Customers and is available on the Services.

LIMITATIONS OF LIABILITY

The party/customer purchasing this service or product hereby certifies and accept that he or she is authorized to permit entry onto the property of the delivery address, to provide purchased services and/or deliver building materials such as fill dirt, topsoil, and other types of aggregates . That delivery includes entry of semi-dump trucks onto any driveways on said property. The loaded dump truck, loaders, or compact track loaders may cause compressions or cracks in the driveway or walkway due to its weight (in excess of 35 tons). In connection with the delivery of materials and presence on the property, you hereby release Loamscape Technologies Inc, and the vendor providing the purchased serivce, from any liability for damages to any improvements on or at the property, including without limitation, damage to driveways, sidewalks, curbs, walkways, lawns sprinkler systems, gardens, septic systems, drain fields, shrubbery, lawn, or flower beds. This Release shall bind all parties who are in any way responsible for the condition of the property, delivery, work, grading/tractor services, or construction activities thereon, including without limitation, any owner, occupant or tenant of the property.

DELIVERY

By accepting the terms and conditions, you acknowledge that each material is or will be unloaded at the most suitable location in your driveway, sidewalk, or street. You grant the truck driver full authority to determine this location, even if you have a different preference. In the event that you are not present at the time of delivery, you understand and accept that the materials will be left unattended. For the delivery to be successful, the road leading to the drop-off point must be at least 11.4 feet wide and capable of accommodating heavy trucks (ground not saturated, sandy, or soft).. If these conditions are not met, the driver will unload the aggregates or goods as close as possible to the designated location. Failure to meet these conditions may result in an additional charge equivalent to the full freight cost for the missed delivery. To facilitate the delivery process, you have the option to describe your preferred delivery location via text messages or phone call. Additionally, you may choose to go outside and mark the designated spot to further assist the driver.. However, please note that each load will be dumped/unloaded at a single spot and will not get spread during unloading. Whether the driver chooses to provide this service is solely at their discretion and cannot be guaranteed by us. It is important to be aware that cancellations are subject to fees. Furthermore, we would like to inform you that we will not be held responsible for any financial implications arising from delivery delays. We strongly advise that when scheduling your project's workforce and equipment, you select a delivery date at least one day prior to their intended usage to mitigate any potential issues.

DELIVERY TIMING & SAME-DAY SERVICE DISCLAIMER

Vendors strive to provide prompt and reliable delivery service; however, same-day delivery is not guaranteed for any orders placed after 10:00 AM or for orders requiring multiple loads or large quantities. Delivery times may vary based on availability, routing, and operational capacity. Customers acknowledge that certain extenuating circumstances—including severe weather, traffic accidents, equipment failures, supplier loading delays, material shortages, or other unforeseen logistical challenges—may result in delayed delivery or rescheduling to the next business day. Vendors will make every reasonable effort to communicate delays and ensure timely service while prioritizing safety and service quality.
